Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Tidbit ("Tidbit", "we", "us") governing your access to and use of the Tidbit gateway service and website at usetidbit.ai (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Tidbit provides a hosted business software service that helps teams manage and reduce the cost of their AI and LLM API usage. The Service is currently offered as an invite-only beta and may change, be limited, or be discontinued at any time.

2. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your API keys and credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date.

3. Acceptable use

You agree not to use the Service to violate any law, infringe the rights of others, transmit malware, attempt to disrupt or reverse-engineer the Service, exceed rate limits, or circumvent usage metering. You must also comply with the usage policies of any third-party AI providers used in connection with the Service.

4. Third-party services

The Service depends on third parties including third-party AI providers and cloud infrastructure providers. Your use of the Service is also subject to those providers' terms. We are not responsible for outages or changes in third-party services.

5. Fees and billing

The Service is free during the invite-only beta. When paid plans become available, fees, subscription terms, and billing will be as described at checkout and in our Refund & Cancellation policy. Paid subscriptions are billed through Stripe and renew automatically until cancelled. You authorize us and our payment processor to charge your payment method for applicable fees.

6. Intellectual property

Tidbit and its software, branding, and content are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service. You retain all rights to the content of your API requests and responses.

7. Confidentiality and data

Our handling of data is described in our Privacy Policy, which is incorporated into these Terms.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will always reduce your costs.

9. Limitation of liability

To the maximum extent permitted by law, Tidbit will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of the Service will not exceed the amounts you paid us in the three months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes take effect constitutes acceptance.
